Samsung Accuses India’s Competition Watchdog of Unlawful Actions

Samsung, one of India’s leading smartphone brands, has accused the Competition Commission of India (CCI) of conducting an illegal raid, detaining its employees, and seizing sensitive data during an investigation related to e-commerce giants Amazon and Flipkart. This dispute stems from allegations that smartphone companies, including Samsung, collaborated with e-commerce platforms for exclusive product launches, potentially harming market competition and consumer choice.

 

 

What Happened?
The issue began in August 2023 when CCI claimed that Samsung and other smartphone companies violated Indian antitrust laws by partnering with e-commerce giants for exclusive launches. CCI believes these arrangements restrict consumer options and hinder fair competition in the smartphone market.

In response, Samsung challenged the CCI's findings, alleging the investigation was conducted unlawfully. According to Samsung's legal filing, three of its employees were detained by CCI officials during a 2022 raid at an Amazon vendor's premises. The company also claims that confidential data was copied from their phones without proper authorization.

 

 

Samsung’s Legal Action
On October 11, 2023, Samsung filed a 32-page petition in the Punjab & Haryana High Court. The company has demanded:

The exclusion of the seized data from the investigation.
Immediate return of the materials collected during the raid.
A halt to the use of this data in CCI’s case against Samsung.
Samsung also secured temporary relief from the court, which paused the ongoing proceedings by CCI. However, the court is yet to decide whether the seized data will be returned or excluded from the investigation.

 

 

The Bigger Picture
The investigation against Samsung is part of a broader inquiry into anti-competitive practices in India’s e-commerce sector. CCI initiated the probe in 2020 after the Confederation of All India Traders (CAIT) filed a complaint. CAIT, representing over 80 million traders, alleged that exclusive phone launches by companies like Amazon and Flipkart hurt small retailers and disrupted fair competition.

As part of this investigation, Xiaomi has also been accused of similar anti-competitive practices through exclusive online sales agreements.
